An operative of the Department of State Services (DSS) on Tuesday told the Federal High Court in Abuja that Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), expressed a desire to include parts of Kogi and Benue States in his proposed Biafra republic.
The DSS operative, identified as BBB, made the revelation while testifying as the second prosecution witness in the ongoing trial before Justice James Omotosho.
He stated that Kanu made the claim during an interview, which was recorded and stored on a compact disc.
Led in evidence by the prosecuting counsel, Adegboyega Awomolo, SAN, BBB testified behind a screen, identifying the disc and a letter from the Attorney General of the Federation (AGF) as evidence of the recorded statement.
However, defence counsel, Kanu Agabi, SAN, objected to the admissibility of the materials, arguing that the prosecution failed to serve the defence copies of the AGF letter and video recording in advance.
He stressed that it was the defendant’s constitutional right to have access to all materials intended for use in court.
Justice Omotosho agreed with the defence, citing Section 36 of the Nigerian Constitution, which guarantees fair hearing and access to relevant materials.
He subsequently ordered the prosecution to serve all necessary documents and facilities on the defence.
Following a request by the prosecution, the judge adjourned the trial to May 7 for continuation of the witness’s testimony and compliance with the court’s directive.
