SAN Calls Court Challenge to Jonathan’s 2027 Bid an ‘Abuse of Process’

A Senior Advocate of Nigeria (SAN), Oba Maduabuchi, has criticised a Federal High Court suit challenging former President Goodluck Jonathan’s eligibility to contest the 2027 presidential election, describing it as an abuse of court process.

Speaking on Arise Television’s Morning Show on Tuesday, Maduabuchi said the issue had already been settled by a competent court in Yenagoa, Bayelsa State, with no appeal filed against the judgment.

“Until that judgment is overturned, it remains the valid legal position. Anyone attempting to relitigate the matter is simply abusing the court process and is a busybody,” he said.

The senior lawyer added that the 2018 constitutional amendment, which limits a person to one further term if they have previously completed another’s tenure, cannot be applied retroactively. Jonathan first assumed office in 2010 following the death of President Umaru Musa Yar’Adua.

“When Goodluck Jonathan took the oath of office, there was no statutory limitation that could prevent him from running for two full terms. The law at the time allows it,” Maduabuchi explained.

The ruling has reignited discussions around Jonathan’s potential candidacy and the legal frameworks governing presidential terms in Nigeria.
