A Nigerian lawyer has issued a warning to wives, stating that a husband can sue his wife for accessing his phone without consent, citing invasion of privacy as a legal basis for a civil lawsuit
She added that wives could also take similar legal action against their husbands.
In a Facebook post on Sunday, January 26, Stella wrote: “Your HUSBAND can SUE you for going THROUGH his PHONE WITHOUT his CONSENT. ACCESSING someone’s PERSONAL ELECTRONIC devices without AUTHORIZATION can be considered as INVASION of PRIVACY.”
She explained that in legal terms, privacy invasion within a marriage is still recognized, and a lawsuit could be filed if the affected spouse can prove intentional breach of privacy, emotional distress, or reputational damage.
“To have a STRONG CASE, the HUSBAND would need to DEMONSTRATE that his WIFE ACCESSED his PHONE with the INTENTION to INVADE his PRIVACY. That this CAUSED him TANGIBLE HARM, such as EMOTIONAL DISTRESS or damage to his REPUTATION,” she added.
